IEP Advocacy Services reserves the right to suspend your account or any part of it if we suspect violations of the Terms, pending an investigation. You will be notified of such suspension where feasible.

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms and Conditions ("Dispute"), you and IEP Advocacy Services agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least thirty (30) days before initiating any arbitration or court proceeding. Such informal negotiations commence upon written notice from one party to the other.
If you and IEP Advocacy Services are unable to resolve a Dispute through informal negotiations, either party may elect to have the Dispute (except those Disputes expressly excluded below) finally and exclusively resolved by binding arbitration. Any election to arbitrate by one party shall be final and binding on the other. YOU UNDERSTAND THAT ABSENT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. The arbitration shall be conducted in the state of Texas and judgment on the arbitration award may be entered into any court having jurisdiction thereof.
The following Disputes are not subject to the above provisions concerning informal negotiations and binding arbitration: (i) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a party; (ii) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (iii) any claim for injunctive relief.
If any provision or part of a provision of these Terms and Conditions is unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and Conditions and does not affect the validity and enforceability of any remaining provisions.
The failure of IEP Advocacy Services to exercise or enforce any right or provision of these Terms and Conditions will not operate as a waiver of such right or provision. Any waiver of any provision of these Terms and Conditions will be effective only if in writing and signed by a duly authorized representative of IEP Advocacy Services.

You and IEP Advocacy Services agree to submit to the personal and exclusive jurisdiction of the courts located within California, to resolve any dispute or claim arising from these Terms.
